Terms of Service

1. Acceptance of Terms

By accessing or using NaijaPlace ("the Platform"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not use the Platform. These Terms apply to all users, including buyers, sellers, browsers, and contributors of content.

2. Eligibility

You must be at least 18 years old to use NaijaPlace. By using the Platform, you represent and warrant that you are at least 18 years of age and have the legal capacity to enter into these Terms. If you are using the Platform on behalf of a business or entity, you represent that you have the authority to bind that entity.

3. Account Registration

To access certain features, you must create an account. You agree to:

  • Provide accurate, current, and complete information during registration
  • Maintain and update your information to keep it accurate and current
  • Keep your password secure and confidential
  • Accept responsibility for all activities that occur under your account
  • Notify us immediately of any unauthorised use of your account

4. Listings and Content

Users who post listings or content on NaijaPlace agree to the following:

  • You own or have the right to post the content, including images and descriptions
  • Content must be accurate and not misleading
  • Listings must comply with all applicable Nigerian laws and regulations
  • You may not post prohibited items including illegal goods, counterfeit products, weapons, drugs, or any items that violate Nigerian law
  • NaijaPlace reserves the right to remove any listing or content at its discretion

5. Prohibited Conduct

You agree not to:

  • Use the Platform for any illegal or unauthorised purpose
  • Post false, misleading, or fraudulent listings
  • Harass, abuse, or threaten other users
  • Spam, send unsolicited messages, or engage in phishing
  • Attempt to hack, disrupt, or interfere with the Platform's systems
  • Scrape, crawl, or collect data from the Platform without permission
  • Circumvent or manipulate the Platform's features, including search rankings
  • Create multiple accounts for deceptive purposes

6. Transactions Between Users

NaijaPlace is a platform that connects buyers and sellers. We are not a party to any transaction between users. As such:

  • NaijaPlace does not guarantee the quality, safety, or legality of items listed
  • NaijaPlace does not guarantee the accuracy of listings or user content
  • NaijaPlace is not responsible for any disputes between users
  • Users are responsible for their own due diligence before entering into transactions
  • We strongly recommend following our Safety Tips when transacting

7. Fees and Payments

Basic use of NaijaPlace is free. We may charge fees for premium services such as ad promotion, featured listings, and other optional features. All fees are:

  • Displayed clearly before purchase
  • Charged in Nigerian Naira (₦)
  • Processed securely through our payment partner, Stripe
  • Generally non-refundable once the service has been activated

8. Intellectual Property

The NaijaPlace platform, including its design, logos, text, and software, is the property of NaijaPlace and is protected by intellectual property laws. You may not copy, modify, distribute, or reproduce any part of the Platform without our written consent.

By posting content on NaijaPlace, you grant us a non-exclusive, worldwide, royalty-free licence to use, display, and distribute your content on the Platform for the purpose of providing our services.

9. Privacy

Your use of NaijaPlace is also governed by our Privacy Policy, which describes how we collect, use, and protect your personal information.

10. Disclaimers

NaijaPlace is provided "as is" and "as available" without warranties of any kind, either express or implied. We do not warrant that the Platform will be uninterrupted, error-free, or free of viruses or other harmful components.

11. Limitation of Liability

To the maximum extent permitted by Nigerian law, NaijaPlace shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data arising from your use of the Platform.

12. Termination

We may suspend or terminate your account at any time for violations of these Terms or for any other reason at our discretion. Upon termination, your right to use the Platform will immediately cease. You may also delete your account at any time.

13. Changes to Terms

We may update these Terms from time to time. We will notify users of significant changes via email or a prominent notice on the Platform. Your continued use of NaijaPlace after changes are posted constitutes acceptance of the updated Terms.

14. Governing Law

These Terms are governed by and construed in accordance with the laws of the Federal Republic of Nigeria. Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the courts in Nigeria.
